Fresno, CaliforniaMy bank account was double charged for overdraft fees. This is not the first time this has occurred, and on previous occasions, I simply called customer service to get the erroneous charges reversed. However, this time, the representative I spoke with refused to refund the charges. She told me that money for 'pending transactions' was 'set aside' until those transactions cleared. This lowered the available balance, and when additional transactions went through, the account was assessed overdraft fees. The overdrafts were deducted from the money that had been 'set aside' for 'pending transactions'. Then, the 'pending transactions' went through and more overdraft fees were charged to the account.
In all, there were six overdrafts and the account was charged for tweleve! I have filed complaints with the Better Business Bureau and the Federal Trade Commission. In addition, I will be closing my Bank of America account asap. I'm sick of their shady practices and 'creative accounting'.

According to your report, you overdrafted your account. Most major banks base charges on 'available balance'. BofA is one of the last banks to have done this and they sent at least three notices starting in 2007 that said they were going to be doing this.
Best of luck to you. These problems will also happen with your new account until you manage your account more responsibly.
Your Problem Isn't The Bank
What happened to you will happen to you at any bank you decide to eventually bank at. They all do it. Then, we'll see another report from you about how your next bank ripped you off as well.
The problem described in your report centers around your debit card. The bank gave to you as a convenience to you, right? It's not convenient when they take fees from you for not being able to properly manage your account when you use it. You'll find that when you stop using it, you'll be much better at managing the account you have. Get yourself a credit card and tell the bank - thanks but no thanks to the debit card.

The bank is double charging her , just like i have over and over tried to put that point across to all you bank of america defenders out there, firstly, if the money isn't there they shouldn't authorize the charge. then they wouldn't have to charge her for the authorization overdraft, oh but wait, earlier that day she probably checked her balance via phone or online, which is always different than your actual checkbook register balance, and saw that they INACCURATELY INFORMED HER OF HER AVAILABLE BALANCE, THUS LEADING HER TO THINK THERE WAS MORE MONEY IN THERE. THEY DONT TELL YOU THEY ARE 'HOLDING extra money for some 14.00 gas purchase they are holding 25.00 bucks for or whatever, until the actual draft comes thru, so they charge you 35.00 for each item they authorize, AND BELIEVE ME THEY WILL ALLOW YOU TO USE YOUR CARD ALL DAY LONG, because they know every time you unknowingly use it its another 35.00 in thier pockets.
So to summerize this:
they misinform you of your available balance
they authorize a higher amount than the actual charge and how are you supposed to that they authorized a higher amount than actually charged?
you think you have money in your account and go spend a couple of bucks via your visa check card,
then they charge you because they are holding funds that you never spent to begin with 35.00 for each authorization
that 35.00 fee is taken directly out of your account that very night, above any other incoming debit or even ' money they are holding for a debit' so if your like millions of americans who aren't millionaires, that 35.00 bucks ( if you lucky only one) many times it is several times because they love to allow you to authorize those little petty small purchases on your check card, and then of course your account goes into overdraft due to thier deceitful sneaky way of how they handle your money, ITS NOT HOW YOU HANDLE YOUR MONEY, people wake up, they are handling your money and literally robbing us right into the poor house. and generally the bank has managed to charge you at least 3 or 4 times 35.00 which of course unless you have a money tree growing in your backyard you can just go pick a couple of hundred bucks off to deposit that very next day when the charge they allowed to authorize that put your account say oh maybe a buck or two in the negetative turns in to a hefty couple hundred bucks

I see hundreds and hundreds of reports on this site all reporting the same thing how bank of america is literally ripping off its customers and getting away with it for millions of dollars daily.
No wonder they were able to bail out countrywide home loans and buying out all these companies, anyone happen to notice that the new policy of ' authorization overdraft fees' just happen to start right about the time the morgage crisis did?
they had to come up with some way of stealing more of our money to pay for thier purchases.
and whoever created the visa check card and the policys and procedures is bank of americas god almighty, the secret to thier sucess................
and this bank just keeps on going, just like the energizer bunny, pounding us with new deceptive ways to steal our money right out of our accounts all the while they never seem to forget to remind you when on the phone how much they appreciate you banking with them. AND WE KNOW WHY what they should be saying to you is, ' and thank you for allowing bank of america to access your money and take it , without your hard earned money that we literally take as much as we please daily, we wouldn't be able to buy out the world. Watch out america , this bank is on a mission, WE better do something about it before its to late and they own everything and everybody. THEY HAVE TO BE STOPPED

It's not the bank's fault, because the OP is spending money that isn't in the account. I am not unsympathetic, but your own post shows that you don't have a clear understanding of how the system works.
For instance you say the bank gives you misleading information. It isn't the bank's role to tell you what should be in your check register. They can only tell you the number they know, and that is rarely the number you need. So if you rely on online balances and don't keep your own register, you get burnt.
You say that banks shouldn't authorize the charge. It's not a charge, it's a debit! It isn't the same thing, doesn't get processed through the same system, has different rules and different laws. Banks aren't any more likely to stop the debit transaction than they are to send someone out to tap you on the shoulder and remind you not to write that check that you cannot cover.
When you, or me, or anyone else opens an account we are given a set of rules that govern that account. Banks have to do this by law. It is almost a sure that you signed a paper stating that you received the rules. If you don't follow the rules, you get penalized.
I don't work for BoA, or for any bank, for that matter. My household accounts are at BoA. I, like millions of others have NEVER paid them an overdraft charge. If you manage your account, you won't have to either. If you choose not to manage your account, you'll find it will continue to be a very expensive way to do business.

Update on Double Charges
I have been talking to Bank of America representatives since I made this post, attempting to reach some sort of resolution. I have learned even more upsetting information about how Bank of America is conducting their accounting - the last representative I spoke with *admitted* that my account was double charged, but also explained that this is Bank of America's policy! They charge your account once when the transaction is pending, and then again when it is posted! And they don't seem to understand why this is upsetting their customers...For those of you who were defending Bank of America, I agree that this wouldn't be a problem if we could keep more money in the account, but we can't. We aren't rich and life is expensive. We're just barely making ends meet, and certainly can't afford $420 in overdraft charges in just two days!

it has nothing to do with being rich. It has everything to do with keeping an accurate register and not overspending your account. Even if you only have $350 a month to live on, if you spend $350 or less you will not get fees. if you spend more than $350, you will get fees. it's very simple.

I had a similar situation happen to me and I am so sick of people saying to keep a Transaction Register instead of relying on Bank of America's online banking to keep an eye on my balance. Someone please tell me what's the point of having Online or Telephone Banking if it's not even accurate?
It's Not a Matter of Defending a Bank
It's a matter of educating YOU as the consumer, but don't worry. You happen to be amongst thousands of people in this country who have no idea how banks work. So let's bottom line this for you:
Bank of America is not the only bank who charges in this manner; most every bank does. No matter what bank you go to - even of you withdraw every dime from Bank of America - what happened to you there would happen everywhere. All of this is in the Terms and Conditions of the Account Agreement you must abide by in order to keep an account there. No bank is responsible for the accurate representation of what is in your account; they have no idea what checks you've written, deposits that haven't been credited to your account, amongst other things. The only person who should know the proper balance is you and if you check online with any bank, you'll find that NO bank will provide you an accurate representation of what is in your account.
Here is some advice for you: stop using your debit card to pay for transactions as soon as you read this. The only reason you would ever use your debit card is if it doubles as your ATM card; as an ATM card, it serves a useful purpose. As a debit card, it will cost you a lot of money. If you're living from paycheck to paycheck, eliminating the use of your debit card to pay for transactions is especially required.
Reduce your life down to cash and checks, keep an accurate check register, and you will never have another overdraft charge ever again. Best of luck to you.
