When my husband and I move to LA, i was'nt working so I decided to find a way to loose some weight. Then I saw the add for Bally with 2 weeks free trial, so I went to BTF and I spoke to one of their employee. He was a Nigerian and since I'm also from Africa he said he was going to make a me deal, which is I can pay $ 25 and me and my husband can use the gym for a month. I agreed and when it came to the time of payment I did't have enough cash on me so I gave him my credit Card.

He came back with a lot of paper work and I said this all for one month and he said yes for insurance and security reasons. and I told him I might not need the entire month because I will be going to Florida. I went to the gym 2 times with a personal trainer and after the two free sections he asked me if i would like to sign up for additional lessons, and I told him no due to palpataions my doctor has ask me to cool things of. That was the last time i was in that gym.

Anyways, about 5 months later, I got a letter from bally claiming they have'nt been able deduct payments from my credit card for the past 2 months( I lost my credit card and have gotten a replacement ). I thought what? why will they be taking money from my credit card? so I called them and they said I had signed up for 3 years with their gym.

I went back to the gym and demanded to talk to the guy who signed me up but the manager told me he is at a diffren gym. And the manager also told me I should hve send the a written request for cancellation. I told him I'm willing to let what ever they have taking from my account go I just want the contract cancelled. Hed said to sent them a written request allong with a doctors note. Three times my doctor sent the note but they claim they didn't get it. The last one I dropt it at front desk my self and I took this girls name.

I didn't hear from them for a while, I moved to New York and I got a call from this office claiming they collection agency and I told him my story and hang up the phone.

Now in philadelphia last week i recieved a call from my bank that my money has been frozen. I called the collecting agency and they said it is from bally. This is joint account for my husband and i.
Please I need help. I need a lawyer who will help me put a stop this company and thier scams.

Do not sign any health club contracts before signing!

Gloria,

Unfortunately, you obviously past the California (maybe Federal) 3-business-day right to cancel contract.

If the contract you signed stated a 3-year contract, you are bound by the contract. You will have a difficult if not impoossible time to prove you did not voluntarily signed up for a 3-year club membership. Can't you use the Bally Total Fitness in Philadelphia?

Never go by any verbal deals stated by slick salespeople as they are working for commission.

Strange ...

The original poster wrote: 'I told him I'm willing to let what ever they have taking from my account go '

This is a mighty odd statement for someone who allegedly 'never' signed up for a contract to begin with.

A more likely scenario is this woman went to the gym two times as stated, then became lazy/demotivated, and had 'buyer's remorse' about signing up for a contract and so she thought she could make up this story to get out of it. Wrong.

BTF Scam

Peter, I don't know if you work for bally or not, but you have no idea how painful it is to be tricked into doing something you did not want to do. The reason why I went twice is beacause the free two weeks came with 3 free personal trainer sections and both times that i went, i had severe palpatations after training so I consulted my doctor and he told me stop the training if not I would have use all the 3 free sections. And the reason why I told the I was willing to let what ever money go is because i did not want to deal with lawyers and people like you. The reason why I didn't know that I signed a contract is because my part of the contract ( the one I had with me ) was not signed so I thought I just signed for the credit card and for the free two weeks.
It is not easy puting all words out when you are typing so don't you dare call me Lazy. I might be a fool going to that gym but do not judge people who have been scam, then it could happen to you too unless you are one of those scammers. If you are, I don't know how much they are paying you but it is not worth the pain and agony you are bringing to innocent people.
